1. Acceptance of Terms

Welcome to Inkwiser ("Service"). These Terms of Service ("Agreement") are a legally binding contract between you ("User," "you") and Inkwiser ("we," "us").

By accessing our website and using our AI-powered book creation tools, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must immediately stop using the Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you have the legal capacity to enter into this contract. Our Service is not intended for use by minors.

3. Description of Service

Inkwiser is an AI-powered platform that guides users through all the steps required to create a book — from initial concept and planning through writing and final export.

4. Account Security

To use certain features, you must create an account. By doing so:

You are responsible for maintaining the confidentiality of your login credentials.
You are fully responsible for all activities that occur under your account.
You must notify us immediately of any unauthorized access to or use of your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Subscriptions and Payments

Our Service operates on a subscription and/or credit-based model:

Monthly Allotment: Based on your plan, you receive a set number of credits or generation allowances each billing cycle.
Expiration: Unless specified in a rollover plan, unused monthly credits expire at the end of each billing cycle.
Top-up Credits: Purchased top-up credits do not expire and will be used only after your monthly allotment is exhausted.
No Cash Value: Credits are non-transferable and have no monetary value.
Automatic Renewal: Subscriptions renew automatically unless cancelled via your account settings before the end of the current billing cycle.
No Refunds: Due to the high computational costs of AI generation, all sales are final. We do not offer refunds for partially used billing cycles or unused credits.
EU Right of Withdrawal: If you are a resident of the EU, you acknowledge that by using credits or triggering AI generation, you are requesting immediate performance of the digital service and thereby waive your 14-day right of withdrawal for that specific transaction, in accordance with Article 16(m) of the Consumer Rights Directive (2011/83/EU).

6. Intellectual Property

6.1 Content Ownership

Service IP	Inkwiser	The underlying algorithms, AI workflows, user interface, logos, and proprietary technology.

6.2 License to Us

You grant us a non-exclusive, worldwide, royalty-free license to host, store, and process your content solely to provide and improve the Service for you. We do not sell your manuscripts to third parties.

6.3 Responsibility

You are solely responsible for the content you generate. We do not guarantee that AI-generated output is eligible for copyright protection under your local jurisdiction. It is your responsibility to verify the legal status of generated content before publication or commercial use.

7. Prohibited Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, or sexually explicit involving minors.
Infringe upon the intellectual property rights of others.
Create misinformation, "deepfake" narratives, or highly sensitive political propaganda.
Use automated systems (bots, scrapers) to extract data from the Service.
Attempt to reverse-engineer our AI processing workflows or proprietary technology.
Circumvent any usage limits, access controls, or security measures.
Use the Service in any manner that could damage, disable, or impair its operation.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

Your right to use the Service will immediately cease.
You may request a copy of your content within 30 days of termination.
We may permanently delete your content after the 30-day period.
No refund will be issued for any unused portion of a subscription or credits.

9. Disclaimers

"As-Is" Basis: The Service is provided without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AI can produce inaccurate, biased, or "hallucinated" information.
No Professional Advice: Our AI is a creative tool, not a substitute for legal, medical, financial, or professional writing advice.
No Guarantees: We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law (including EU consumer protection law):

Inkwiser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the one (1) month prior to the event giving rise to the claim.

11. Data Protection

Your use of the Service is also governed by our Privacy Policy , which is compliant with the GDPR. We process your data as necessary to perform this contract. Please review the Privacy Policy for details on how we collect, use, and protect your information.

12. Dispute Resolution & Governing Law

Governing Law: This Agreement is governed by the laws of the European Union and the applicable national law of the member state in which we are established.
Jurisdiction: Any disputes arising out of these Terms shall be resolved in the competent courts of the EU member state in which we are established.
Online Dispute Resolution: For EU consumers, the European Commission provides an online dispute resolution platform at https://consumer-redress.ec.europa.eu/index_en

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
